PUPPY DEPOSIT & PURCHASE INFORMATION WITH CONTRACT
Puppies may be sold with AKC limited registration; go to www.akc.org to get details of registration.
I accept cash only. Deposits for puppies is ONE HALF the purchase price with the remaining balance due when puppy is to be picked up.
Deposits are non-refundable. 1st deposit on females gets first choice of females, 2nd deposit the same and so forth; SAME for the males with the 1st deposit on males gets first choice on males, etc.
If puppies are not picked up within 24 hours of said pick up date and prior arrangements have not been made, you lose your deposit. In addition, puppy goes back for sale, no exceptions.
This puppy is guaranteed to be in good health and free of communicable diseases for 24 hours after pick up or delivery. If this puppy should become ill during this time, seller is to be notified and puppy is to be returned immediately. New Owner must be able to give account of travel conditions as well as all that has transpired within the 24 time frame (including anything that pup may have ingested) for Vet Check Guarantee.
PUPPY GUARANTEE
1. All guarantees apply to the original buyer only. Guarantees are not transferable.
2. Dog must not have whelped or sired a litter within the first two years and/or before OFA Certification on hips.
3. This puppy is guaranteed to be free from hip dysplasia up to 26 months of age. I do not guarantee the elbows, shoulders or hocks.
OFA CERTIFICATION must be completed by the time the dog is 26 months.
4. If the dog is 26 months of age or younger, has failed the OFA Certification then proceed with these:
A copy of Vet Checks/Visits with history must accompany with the following:
Notify the Breeder/Seller by letter giving your name, address phone number, dog's name, AKC number, age, sire & dam's names, a copy of the OFA letter stating the problem and Evident/potential cause.
All costs for OFA, fees, etc. are the responsibility of the buyer/new owner of puppy/dog. If dog is found to have hip dysplasia and all conditions apply, you qualify for replacement of your pup. AKC papers must be sent back to Breeder/ Seller. (go to www.akc.org for owner info. If current information you have is no longer valid)
Replacement of Puppy:
If the dog meets all the conditions of the guarantee, I agree to replace the dog with a puppy of Equal Quality, same sex & color; to be selected from a litter at my discretion & availability.
If the price of the replacement puppy is higher than the price you paid for your puppy, you
must pay the difference.
No cash refund will be made, ONLY Puppy Replacement; I will make every effort to replace the puppy ASAP
I, the Breeder/Seller, am NOT responsible for any other accidents, conditions, diseases, death, etc. to the puppy after pick up/delivery.
If OFA does not pass due to an injury or accident the puppy/dog had obtained, or the puppy/dog
is not in GOOD HEALTH due to being overfed, under fed, neglected/abused in any way, etc. THIS GUARANTEE IS NULL AND VOID AND THERE WILL BE NO REPLACEMENT PUPPY.
I reserve the right/first option to get puppy back if buyer/new owner needs, FOR ANY REASON, to place puppy in another home, release ownership, adopt out, etc. This does not bind me (seller/breeder) in anyway to buyer/owner; it ALLOWS Rights with a FIRST OPTION to me, the Breeder/Seller.
*Amendments:
I do not grant permission for any of my offspring (pups and/or dogs) to be sold, placed, given up, surrendered, handed over and/or anything of the like, but not limited to single ownership (i.e., third-party, family member, etc.) for any kind of testing purposes (pharmaceutical, dietary, including and/or not limited to anything of the like). Refer back to contract for purposes of right of first option.
If puppy/puppies come back to me (as stated) for any reason, I (breeder/seller) regain ownership of said puppy/puppies. Even if paperwork, applications, etc. have been sent, filed or are for any reason unavailable in hard copy form at the time of exchange of puppy/puppies, any and all documents are the property and ownership of me (breeder/seller) as well. In addition, If any papers/applications have been filed with perspective operations, i.e.: AKC, AVID, etc, the buyer/new owner (who is now the previous owner) is responsible for all processes of transfer of ownership back to me (breeder/seller) including any and all fees incurring and the previous owner MUST sign over transfer when paper, applications, etc. are available in hard copy, in the event hard copy was not available.
Furthermore, if legal litigation is necessary for any reason in the process of the sale, transfer of ownership, return of puppy/puppies, and any other business transaction regarding Labs of Luv, the undersigned will be responsible for any and all attorney fees, court costs, filing fees, serving fees, and any other subsequent fees that may arise and that are allowable by any residing judge within the US.
There will not be refund for puppy, however, if you have had the puppy for less than one month:
$100 for Fox Red returned
$25 for Chocolate, Yellow, Black
